Access to and use of the Website by the user implies acceptance of these General Conditions of Access and Use, as well as the Website's Privacy Policy.

Users should carefully read the General Terms and Conditions of Access and Use and the Privacy Policy before using the Website, as these may be adapted and/or modified at any time. If you do not agree to these General Terms and Conditions of Access and Use, please refrain from using the Website and its content.

Use and operation of the Web

The user undertakes to make diligent use of the Website, as well as the information relating to the products and services detailed therein, in full compliance with both the applicable regulations and the General Conditions of Access and Use and, where appropriate, any other condition that Bysandrasas establishes for this purpose on the Website.

Bysandrasas makes every effort to keep the website functioning properly, preventing errors or, where necessary, correcting them, and keeping the website content up to date. However, Bysandrasas does not guarantee the availability and uninterrupted access to the website, nor the absence of errors in its content, nor that the content will be updated in a timely manner.

Responsibility

Additionally, Bysandrasas is not responsible for any damage and/or loss to the user's software and/or hardware resulting from access to and use of the Website.

The user will be liable for any damages of any kind that Bysandrasas may suffer as a result of the breach of any of the obligations to which he is subject under these General Conditions of Access and Use, the other conditions provided on the Website and/or the legislation applicable at any given time.

   In the event of non-compliance with any of the terms referred to above, Bysandrasas will proceed, immediately, to revoke the consent granted to the Linking Site, who must remove the link.

Through the General Conditions of Access and Use, the user is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or any other form of dissemination not expressly authorized of the Website, the Contents and/or the distinctive signs of Bysandrasas.

Unauthorized use of the Content, as well as any damage caused to the intellectual and industrial property rights of Bysandrasas, may give rise to the exercise of the corresponding legal actions, and the responsibilities that may arise from them.

Nullity

If any clause of these General Terms and Conditions of Access and Use is declared wholly or partially null or ineffective, such nullity or ineffectiveness will affect only that provision or the part thereof that is null or ineffective, and the remaining provisions will remain in full force and effect, with the affected provision or part thereof being deemed not to have been included. To this end, the General Terms and Conditions of Access and Use will only cease to be valid with respect to the null or ineffective provision, and no other part or provision thereof will be annulled, invalidated, impaired, or affected by such nullity or ineffectiveness, unless, due to its essential nature, it must affect the General Terms and Conditions of Access and Use in their entirety.

Shipping costs.

Shipping and/or handling costs are not included in the price and will be shown to you for your express acceptance before finalizing your purchase, depending on the shipping address of each order and the delivery method you have chosen.

Order placement.

To place an order, you must log in to bysandrasas.com and complete the electronic form that appears on the website, following the instructions provided. Bysandrasas provides users with all the necessary technical resources to identify and correct errors in the data entered on the various forms that appear on the screen during the purchase process.

Order details that have already entered the preparation process for shipment cannot be modified.

After registering, and to proceed with the purchase of products, you must add the product you wish to purchase to the cart, according to the instructions shown on the screen, completing the order form provided for this purpose and validating it.

The prices and offers shown on this website are valid solely for online orders placed at bysandrasas.com or through their telephone sales service and may not match the prices and offers available at other Bysandrasas stores in Spain. All prices published on our website include indirect taxes.

The customer's order confirmation expressly implies knowledge and acceptance of these general terms and conditions as part of the contract. Unless proven otherwise, the data recorded by Bysandrasas constitutes proof of all transactions between Bysandrasas and its customers. Bysandrasas will archive the electronic document formalizing the contract, and this document will be accessible.

Once the purchase is complete, and as soon as possible, but always within 24 hours of the purchase, Bysandrasas Customer Service will send you a purchase confirmation by email. If you do not agree with the information in this confirmation, you can request its modification or the cancellation of the contract.

 Upon your express acceptance of these terms and conditions, Bysandrasas will issue an electronic invoice. Once your order is paid, this invoice will be generated by the system and sent to the email address you provided on the purchase form. This excludes telephone orders and orders paid by bank transfer, in which case our Customer Service Department will issue and send you the corresponding invoice as soon as you complete your payment. Bysandrasas advises that sales invoices cannot be modified once issued, without prejudice to your right to obtain a corrected invoice in the cases provided for in current regulations (Royal Decree 1619/2012, of November 30, which approves the Regulation governing invoicing obligations). The invoice is issued to the individual or company listed in the billing address provided when placing the order, so please ensure you place your order with the correct billing address.

Product availability.

The selection of products offered on bysandrasas.com is valid as long as the products are visible on the website, subject to stock availability. Since this is an e-commerce site, stock is updated online, so it is possible that during the purchase process an item may run out of stock. In such cases, the purchase cannot be completed. Therefore, if the quantity ordered exceeds the available stock, products will be sold according to the order in which the order was received.

Our commitment to dispatch from our warehouse is 24-48 working hours.

In addition to the above availability, please note the delivery times of the transport companies we work with. These times are calculated in working days – Monday to Friday – as Bysandrasas does not ship on holidays, Saturdays, or Sundays.

In the event of a stock shortage or temporary unavailability of an item, Bysandrasas will contact you to inform you and provide a new delivery date. If it is not possible to supply the product, the order will be canceled, or you will be offered a similar product of equal or even superior quality at no additional cost. In any case, a delay in delivery beyond the stated timeframe will not entitle the customer to any compensation.

Shipping times.

The standard delivery time within mainland Spain is 48 hours, but it may take up to 10 business days, excluding Saturdays, Sundays, and public holidays. This timeframe may vary depending on the product. Products are shipped to the delivery address you provided in your order. If you order multiple items with different availability dates, the shipping timeframe will be based on the item with the longest estimated delivery time. In exceptional cases, Bysandrasas reserves the right to split the order, shipping the available items and sending the unavailable items in a second shipment. In this case, the second shipment will be sent at no additional cost.

Payment methods.

 Bysandrasas offers various payment methods so you can choose the one that best suits your needs:

Credit Card Payment: You can use Visa, Maestro, or Amex. If the payment terminal reports that the card has been declined, the order will be automatically canceled, and the customer will be notified online. For payments made with cards issued outside of Spain, the issuing bank must be enrolled in the Secure Electronic Commerce (CES) protocol. Payments with cards that do not meet this requirement will not be accepted. As an alternative, we offer payment by bank transfer. For security reasons, Bysandrasas reserves the right to refuse certain credit card transactions. If an order is canceled after payment has been processed, the amount charged will be refunded to the original credit card used for the transaction. In these cases, if the customer wishes to proceed with the purchase, they can place a new order, selecting bank transfer as the payment method.

Payment by Bank Transfer: This payment method is limited to orders over €100. After placing your order, the system will send you an email with instructions for payment by bank transfer. You have 2 business days to initiate the transfer after placing your order. The order will not be considered valid until we confirm receipt of payment, and therefore, delivery times begin from this date.

Payment with PayPal: This payment method allows you to pay quickly and securely with your PayPal account, without sharing your financial information with Bysandrasas.es. You will be redirected to PayPal's secure website, where you will enter your PayPal account credentials, authorize the payment, and then proceed to shop.bysandrasas.es, where we will confirm your order. Once you have received the order confirmation, PayPal does not allow you to modify the shipping address. When using this payment method, you will only be charged for the items shipped and at the time of shipment preparation. A pre-authorization for the total amount of your purchase will appear on your bank statement. This pre-authorization will be automatically released within 7 days, depending on your bank. Check all the details in your PayPal account.

Right of withdrawal.

If you are not satisfied with the products purchased exclusively at shop.bysandrasas.es, you have the right to withdraw from the contract by returning your purchases to our online store, in accordance with the provisions in the following paragraphs.

Period for exercising the right of withdrawal: You may exercise your right of withdrawal without giving any reason within 14 calendar days. If the product is returned without its original packaging, its value may be reduced.

The withdrawal period will expire 14 calendar days from the day you, or a third party designated by you other than the carrier, received the goods. If you purchased multiple goods in the same order that were delivered separately, the withdrawal period will expire 14 calendar days from the day you, or a third party designated by you other than the carrier, received the last of those goods.

How to exercise the right of withdrawal:

To exercise your right of withdrawal for products purchased exclusively at shop.bysandrasas.es, you must unequivocally state your decision to withdraw from the contract by contacting our Customer Service Department by sending an email to info@bysandrasas.com.

The right of withdrawal will be considered exercised within the deadline when you have sent us the communication relating to the exercise of this right before the end of the corresponding period, under the terms indicated above.

Consequences of withdrawal:                                                                       

If you exercise your right of withdrawal, we will reimburse all payments received from you, including delivery costs, unless you chose a delivery option other than the least expensive standard delivery, in which case the additional costs will not be refunded. Reimbursement will be made without undue delay and in any event no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. However, reimbursement may be withheld until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest.

We will process your refund using the same payment method used for the purchase. You will not incur any additional costs as a result of the refund, except for the return shipping costs. In all cases, returned products must be in perfect condition and include all manuals, accessories, gifts, vouchers, coupons, or any other promotional benefits, if applicable. If the product is returned without its original packaging, its value may be reduced.

The right of withdrawal will not apply to contracts relating to:

The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery

In the case of promotions where several independent items are purchased as part of the same pack (3x2, 2x1 and similar), in case of withdrawal, all products included in the promotion must be withdrawn.

The right of withdrawal regulated in this section will only apply to products purchased solely and exclusively through info@bysandrasas.com, and will not apply in any case to products purchased in a physical store or any other physical or online establishment.

The consumer will only be liable for the decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics or functioning.

Issues in product delivery.

Without prejudice to and completely independent of the right of withdrawal and the legally recognized guarantee on non-conforming products, the circumstances that may cause an incident in the delivery of your product are the following:

1. a) Product damaged in transit: If at the time of collection or delivery of the product you detect any damage to the packaging or product, you must note it on the POD (proof of delivery) of the carrier and contact our Customer Service Department via email info@bysandrasas.com, as soon as possible, to report the incident.
2. b) Product that, due to an error, does not correspond to the order: this must be reported within 14 calendar days. Bysandrasas will cover the costs of collecting the incorrect product and delivering the correct one.

Product warranty.

The warranty period is two years from the delivery of the product, although it does not include defects caused by negligence, impacts, incorrect use or improper handling, incorrect installations not carried out by authorized Technical Services when applicable, etc., nor materials that are worn out by use.

Bysandrasas reserves the right to request an official technical service of the brand to verify the origin of the problem or cause of the non-conformity.

If a defect is found to be caused by misuse, the repair will be billable. In cases where the warranty applies, the option will be repair, replacement, price reduction, or refund, in accordance with legal regulations. These procedures will be free of charge for the consumer.

These General Terms and Conditions are governed by Spanish law. The parties submit to the jurisdiction of the courts of Barcelona (Spain) for the resolution of any disputes, expressly waiving any other jurisdiction.
